Spears had primary custody of her two children with Federline, Sean Preston, born September 14, 2005, and Jayden James, born September 12, 2006, under a 50/50 custody arrangement, which was part of the divorce settlement reached by the couple in July, 2007.
However, she lost physical custody to Federline on October 1, 2007, after he went to court in September over her increasingly erratic lifestyle and substance abuse. Britney's overnight visitation privileges with her kids were suspended on January 2, 2008, after she refused to return them to Kevin's custody following a scheduled visitation on January 2. A stand off with the police ensued after which Britney was forcibly hospitalized at Cedars-Sinai Medical Center in Los Angeles. LA County Superior Court Commissioner Scott Gordon, who is presiding over Britney Spears' child custody dispute with ex Kevin Federline, granted the now recovering pop star overnight visitation privileges with her two toddlers on Tuesday, June 24. Britney's lawyer in the custody dispute, Laura Wasser, probably understands that Britney stands to gain more from an out-of-court settlement since she is under a conservatorship which would constrain the court's ability to restore her primary custody privileges.
